我国绿色技术专利司法强制许可研究

强制许可是解决绿色专利实施的有效途径,但我国绿色技术专利行政强制许可的实施存在法律制度上的障碍,短时间难以克服。法院在公共利益认定上具有天然优势,其根据个案做出绿色专利侵权不停止侵害的判决国际影响较少且能达到强制许可的目的。其替代措施"合理费用"的确定应以公共利益为主要考察基点。

Compulsory licensing is an eiiectlve way to solve green patent appHt.at,u,a, u obstacles to patent compulsory license system in the legal system of green technology in China. The court has a natural advantage in the determination of public interest, which makes the judgment of the green patent in- fringement not to stop infringement according to the case, and can achieve the purpose of compulsory licen- sing. The determination of the reasonable cost should be based on the public interest.
