少数人权利保护的法理思考——以宪法为视角

A Legal Reflection on the Protection of Rights of the Minority

少数人权利保护是人权保障中的重点问题。从"少数人"的词源、概念演变到"少数人权利"的主要内容出发,论证少数人权利保护的正当性及少数人权利之宪法保护,分析保护少数人权利在中国的现状,辟出少数人权利宪法保护的路径,尝试以宪法保护解决社会中存在的诸如少数人地位不平等等问题,进而弥补这些不平等产生的不利后果,实现社会的和谐和个人的平等。

The protection of rights of the minority is a key issue in the protection of human rights. Based on the introduction to the origin and concept of＂the minority＇and the main content of＂rights of the minority＂, the paper demonstrates the legitimacy of the protection of rights of the minority and the constitutional protection of rights of the minority,analyzes the present situation of the protection of rights of the minority in China and explores the path of constitutional protection of rights of the minority. It attempts to solve the problem of the inequality of the social position of the minority and make up for the adverse consequences of these inequalities to realize the harmony of society and the equality of individuals.
