摘要
近年来,我国发生了多起校园欺凌和校园暴力案件,它们严重损害着未成年人的身心健康,急需有效治理。基于对校园欺凌和校园暴力认知不足、惩戒乏力的基本判断,以我国相关立法和政策分析为源,以域外相关治理经验为镜鉴,提出了治理校园欺凌和校园暴力的法治建议:即依法界定校园欺凌和校园暴力行为、严肃法律责任追究、细化校园安全法治教育、创建校园安全法定防卫体系、确立学校的安全保护义务。
In recent years, there have been many cases of school bullying and school violence in China. They seriously impair the physical and mental health of minors. It calls for effective governance. Considering the lack of knowledge and legal system, we should formulate anti-school bullying and anti-violence law, pursue legal responsibility, carry out safety education, create security system and establish safety protection obligations on the campus.
