国际经济法存在与发展的新视角

A New Vision on the Independence and Development of International Economic Law

在我国学界占主流地位的"大国际经济法观"认为,国际经济法是适应国际经济交往发展的现实需要产生的,其存在的独立性可以从破除传统的公法与私法二元对立的跨学科角度加以解释。除此之外,德国学者卢曼等人的"社会系统理论"其实为国际经济法的独立性提供了更深层次的社会学解释。经过三十多年,国内学界对于国际经济法的研究已呈现多元视角的繁荣局面,越来越多的研究视角有助于更为全面深入地理解国际经济法,推动国际经济法的发展进步。在当前中国积极有为的外交新常态下,推动国际经济法的"包容性"发展,通过国际经济法促进各国共同发展、寻求共赢,并且促进发展成果惠及各国全体人民,已成为国际经济法研究新的历史使命与担当。

In China's academia,the mainstream viewpoint on international economic law( IEL)holds that IEL govern all the international economic activities and transactions,including the ones in which private parties get involved. In support of the disciplinary independence of international economic lawas such,leading scholars in this field insist the binary opposition between public lawand private lawshould be deleted. Furthermore,the social systems theory,being developed mainly by Niklas Luhmann,has provided a solid foundation for IEL in a sociological perspective. Since early 1980 s,Chinese scholars have developed diversified perspectives and made great achievement in the research of IEL,which adds much to the development of IEL. Today China is playing a proactive and enterprising role in advocacy of inclusive development of the world society,which benefits both the countries concerned and their people. Accordingly,Chinese Scholars should commit more efforts to boost the inclusive development of IEL.
