摘要
无固定期限劳动合同具有用工稳定和留住人才的市场功能。但由于我国严格的解雇保护制度和不合理的强制缔结无固定期限劳动合同的规定,用人单位因担忧解雇难而排斥选择无固定期限劳动合同,使我国的无固定期限劳动合同制度的实施陷入困境。破解我国无固定期限劳动合同制度的实施困境路径在于适当放宽解雇条件和取消无固定期限劳动合同强制缔结中的不合理的规定,在劳动关系的和谐中谋求劳动关系的稳定。
The non-fixed-term labor contract aims to stabilize the labor relationship and retain the talents in market economy.But due to the strict dismissal protection system and unreasonableness of compulsory provisions in regard of entering into non-fixed-term labor contract,the employers are afraid of the difficulty of dismissing the employees and therefore reject choosing the non-fixed-term labor contract,thus the plight of such labor contract's implementation appeared.To solve the problem,it should properly release the conditions of dismissal and abolish the unreasonable compulsory provisions of entering into non-fixedterm labor contract.
