海上货物运输保险责任期间与承保风险、保险利益共同构成了保险责任成立的三个要素.目前市场上使 用的海上货物运输的保险条款包括198 2年伦敦保险协会货物保险条款、 2009年伦敦保险协会货物保险条款以及中 国人民财产保险股份有限公司海洋货物运输保险条款,三个条款中关于责任期间的规定不尽相同,而对于相同的条 款实务中也会有不同的理解.因此,有必要“咬文嚼字”地去研究条款本身用词,确定不同条款下货物运输保险期间 的涵盖范围.结合三个条款中关于责任期间的不同规定,分析每个条款中具体的用词,研究各个条款下责任期间的 涵盖范围,并结合保险利益原则分析保险责任期间条款的修正及补救.

Duration of marine cargo insurance duration, insurance risks and insurance interests constitute three elements of the establishment of the insurance liability. Currently on the market using ICC 82, ICC 09 and PICC clauses,the respective terms on the period of liability vary, and even for the same term the practice also has different understanding. Therefore, it is neces-sary to study these terms clause according to the principles of interpretation identified in terms of intention. This paper will, by combining various provisions concerning the period of liability in these three terms, analyze them in terms of specific words, examine coverage of the various liability under the terms, and discuss the correction and remedy for these terms by combining the principle of insurable interest during the analysis.
