论网络“暴恐”之性质

On the Attribute of Cyber Terrorism

伴随着网络信息技术的快速发展,网络"暴恐"已经逐渐成为暴力恐怖主义犯罪的重要方式之一。从犯罪学角度来看,网络"暴恐"本质上是一种恐怖主义犯罪,它是恐怖分子基于政治性目的而实施的具有暴力性或破坏性的行为。同时,网络"暴恐"也是一种网络犯罪,是犯罪分子利用网络作为犯罪的工具或者是将网络系统作为攻击的对象所实施的暴力恐怖主义犯罪。从刑法学角度来看,网络"暴恐"构成我国刑法上的犯罪行为,它是恐怖分子个人或恐怖组织出于一定的政治性目的,以作为或者不作为的方式实施的危害公共安全的故意犯罪。

Along with the rapid development of cyber information technology,cyber terrorism has become an important means of terrorism crime. In criminology,cyber terrorism is in essence a terrorism crime that terrorists commit on a political purpose. It has a very wide and uncertain target,and often brings about some terrible consequences. At the same time,cyber terrorism is also a cybercrime. Terrorists always use the cyber as criminal tools,or take cyber system as targets. In criminal law,cyber terrorism is a crime act in our country. It is an intentional crime that terrorists or their organizations commit for certain political purposes,which endangers the public security.
