法治思维下网约车规制的挑战与对策

Challenges and Countermeasures under the Legal Thinking about Online Car Booking Regulation

2016年7月28日,国务院七部委联合出台《网络预约出租汽车经营服务管理暂行办法》(以下简称为《暂行办法》),为推进国家"互联网+便捷交通"战略的实现提供了制度保障。然,囿于网约车服务业态本身的创新性与复杂性,《暂行办法》的落实仍是一个难题。鉴于此,文章认为各地在制定网约车管理细则时可以从明确网约车的定位、引导行业结构走向市场化、强调平台的法律责任和保护好网络个人信息这四方面加以省思。

gOn July 28,2016,the seven ministries in the State Council jointly issued Interim Measures for the Administration of the Operation and Service of the Online Taxi Booking（hereinafter referred to as the Interim Measures）,to provide an institutional guarantee for the realization of the national＂Internet＋convenient transportation＂strategy.However,limited by the innovation and complexity of the online taxi booking service industry,the implementation of the Interim Measures remains a problem.In view of this,the paper puts forward that while working out the detailed rules of online taxi booking management,the local government should think about the following four aspects：making clear the orientation of online taxi booking,leading the industry structure to the market,emphasizing the legal responsibility of the platform,and protecting the online personal information.
