论有限政府理论视域下汉冶萍公司际变之缘由

On the Causes of the Decline of Hanyeping Steel and Iron Corporate with the Limited Government Theory

以行政法治视域之有限政府理论检视晚清工业化失败原因,不仅可以拓宽现有汉冶萍研究领域,还为透析晚清中国法治缺失补充了一个新样本,更可为当今市场经济条件下梳理政企关系提供历史借鉴。政府的不当干预直接推动了汉冶萍公司衰落覆亡,究其原因,晚清政府并没有达到有限政府理论的要求,表现在:一是政府行权目的是维护封建统治;二是政府权力没有受到合理制约;三是政府内部没有实行法治;四是不是有效政府。

To exfumne the cause of the failure of industrifdization in the late Qing Dynasty in view of the limit-ed government theory in administrative law, can not only broaden the existing research fields of Hanyeping Steel and Iron Corporate, add a new sample for analyzing the lack of the rule of law in the late Qing Dynasty of Chi-na, but also provide historical reference on how to handle the relationship between government and enterprises in the current market economy. The decline of Hanyeping Steel and Iron Corporate was quickened by improper government intervention in the following four aspects： Firstly,the exercise of power by the government serves the purpose of defending the feudal rule; Secondly, the power of the government is not reasonably restricted; Thirdly, it is not a rule of law government;Lastly,it is not an effective government. All these show that the gov-ernment in the late Qing Dynasty did not meet the requirements of the limited government theory.
