土地确权与新生代农民工土地权益保护

Confirmation and Protection of Land Rights for New Generation of Migrant Workers

湄潭试验"增人不增地,减人不减地"的土地分配制度引起了广泛的争论,特别是土地确权后,新生代农民工的土地权益如何保障,既有研究也没有一致意见。学界在讨论新生代农民工的土地权益时,常常将农村土地当作一个整体来分析。在城市化背景下,不但农村村庄发生了变化,有征地型、未征地型村庄等不同类型,而且农村土地也有不同类型,这就决定新生代农民工的土地权益不能一概而论。通过实地调查发现,不同类型的村庄对新生代农民工土地权益的保护并不相同,同一村庄不同类型土地给予新生代农民工的土地权益也不一样。保障新生代农民工的土地权益,应该根据村庄和土地的不同类型分别进行分析,并以多维度视角解决。

In the land allocation system,the method of keeping the land area the same no matter the number of a family changes or not in the Meitan test,has aroused a wide range of controversy.In particular,there is no consensus on the study about how to guarantee the land rights of the new generation of migrant workers after the land ownership is confirmed.When discussing the land rights and interests of the new generation of migrant workers,the academic circle often analyzes rural land as a whole.Under the background of Urbanization,not only the rural villages have changed--there are different types of land acquisition,landless type of villages,but also different types of rural land,which determine that the land rights and interests of the new generation migrant workers can＇t be generalized.Through field investigation,it is found that different types of villages have different protection of the land rights and interests of the new generation of migrant workers,and the land rights and interests of the new generation of migrant workers in different types of land are different in the same village.To protect the land rights and interests of the new generation of migrant workers,we should analyze on basis of different types of villages and land,and solve the problem by multi-dimensional perspective.
