Law of Twelve Tables in China

民国初期,《十二表法》首次被译成中文,引起学界关注。1949年以后,这种关注维持,表现为许多学者在自己的论文中把《十二表法》的许多规定当作现代某一法律制度的起源。该法只有少数制度被现代作者负面评价。由于《十二表法》的许多规定已转化为现代西方法的条文,中国在继受现代西方法时间接继受了《十二表法》,但有些与《十二表法》类似的中国制度可能是本土起源的。《十二表法》在中国的广泛影响证明了其优秀性。

In the early period of the Republic of China,the Law of Twelve Tables was translated into Chinese for the first time,which attracted the attention of academic circles. After 1949,this kind of concern is maintained,many scholars in their own papers definited many provisions of the Law of Twelve Tables as the origin of some institution of modern legal system.Only a small number of provisions of this law were negatively evaluated by modern authors.Many provisions of Law of Twelve Tables has been transformed into provisions of modern western law,so China has received the Law of Twelve Tables when she received the modern western law.But some Chinese institutions similar with the Law of Twelve Tables may have the origin of the Chinese ancient law.The extensive influence of Law of Twelve Tables in China has proved its excellence.
