Research on national defense patent disclosure

我国国防专利公开制度因保密制度的存在,使得其区别于民用专利公开制度。文章通过分析国防专利公开制度对专利申请新颖性、创造性的影响,国防专利知识产权属性的矛盾显示我国国防专利公开制度目前还存在着很大的现实问题,国防专利条例应当具体明确国防专利的解密与保密条件,制定解密定密的标准、实现公开制度中信息的合理披露,以实现我国国防专利公开制度转化国防专利价值、促进国防科技成果产业化的作用。

Because of confidential system, the system of national defense patent disclosure in China is different from civil patent disclosure system. This paper analyzes the impact of national defense patent disclosure system on novelty and creativity patent application and finds that the contradiction of national defense patent intellectual property implies the system of national defense patent disclosure in China at present still has a severe realistic problem. The national defense patent regulations should specify terms of confidentiality and decryption, set up standards and disclose proper information of disclosure system, in order to realize the role of the system of national defense patent disclosure in transforming the value of national defense patents and promoting the industrialization of scientific and technological achievements of national defense.
