法治视角下的民事检察诉中监督

Procuratorial Supervision of Civil Litigation from the Perspective of Rule of Law

民事检察监督具有"监"和"督"两个层面的内涵,也即观察被监督的对象,以及在观察的基础之上提出督导性意见。在法治视角下,民事检察的诉中监督是针对诉讼整体过程、全部活动的,有特殊的监督范围和特别的监督方式,与传统的结果监督相区别并有着独立的意义,构成我国法治体系结构中的"栋梁"。

Civil procuratorial supervision has two level of meaning： ＂supervision ＂ and ＂push＂ , that is to supervise the object, offer a proposal on the basis of o supervision. In the view of rule of law, the supervision of civil prosecutorial action is aimed at the whole process of litigation, all activities, has a special supervision scope and a special way of supervision. It is different with the traditional supervision of the result , has independent significance. It is the pillar of China＇s law system .
