在我国初步建立起中国特色社会主义海洋环境保护法律体系的当下,对立法质量的提升已成为实现良法善治的关键。将我国海洋石油环境规制的现实涵摄于环境法令时,殆无疑义,传统法学的研究范式已无法解构目前我国海洋环境法治面临的低效率困局。因此,从寻求有效率的规制视角出发,探寻海洋石油环境规制无效的成因和突破,无疑是实现我国海洋环境法治返本开新的一种创新性尝试。文章运用成本效益分析方法,解析海洋环境规制低效率的原因,旨归在于有效率地解决环境"公地属性"与市场"逐利本性"的现实悖论,进而究寻未来海洋环境规制的应然路径。

Along with the establishment of Chinese marine environmental legal system, the improvement of Chinese marine environmental regula- tion has become an urgent task in order to achieve good governance. However, when reflecting the environmental regulation in the field of offshore oil exploration into the reality, it is argued that the traditional paradigm of regulation could no longer solve the inefficiency dilemma. Therefore, in order to establish an efficient regulation mechanism, it is important to explore problems and difficulties in current environmental regulation. Therefore, this paper uses the cost - benefit analysis as a tool to explore inefficient reasons in the field of marine environmental regulation. The aim of this paper is to find out an efficient solution to solve the paradox of ＂tragedy of commons＂ and the market ＂profit -driven nature,＂ and then to outline a modified path for the marine environment regulation.
