提高专家参与的效能是提高地方立法的质量客观需要。从专家参与地方立法的过程看,应当从三个方面来提高专家参与的效能:一是在确定专家人选时,综合考虑专家的专业领域归属、行政区域归属、业务类型以及性别、民族等因素;二是在组织专家参与地方立法时,不仅应当准许专家选择参与事项,向专家提供大量信息和必要的报酬,全力保障专家的参与,而且应当通过建立专家回避制度等方式对专家参与施加必要的限制;三是通过公开专家参与地方立法的情况和对专家的参与情况进行考核,加强对专家的监督。

In order to improve the quality of local legislation, we must improve the efficiency of expert participation. In view of legisla- tive procedure, the efficiency of expert participation in local legislation should be improved from the three aspects. Firstly, when deter- mining the expert candidates, the professional fields , administrative regions, gender, ethnic group and other factors should all be taken into account; Secondly, when organizing experts to participate in local legislation, not only should experts be allowed to choose matters to participate in, providing a large amount of information and the necessary financial rewards to the experts, so as to ensure the experts par- ticipation, but also necessary restrictions should be imposed on the experts participation through the establishment of expert avoidance system; Thirdly, by making the experts participation in local legislation known to the public and by assessing the expert participation, the supervision on experts is strengthened.
