加强设区的市人大立法能力建设的路径选择

Legislative Capacity Building in the Municipal People's Congress Regarding the Newly Acquired Legislative Power

我国新增立法权的设区的市人大立法能力不能满足立法所需,因此必须加强人大立法能力建设。这就要求科学遴选人大代表,对当选代表加强教育培训,并推行专职化来加强人大代表立法能力建设。同时要建立健全立法体制,确保地方立法坚持党的领导、人大主导、社会各方有序参与,为人大立法能力建设提供体制保障。此外,还要用设区的市地方立法质量和实际社会效果来衡量人大立法能力建设,优化地方立法运行机制,从而不断提升人大立法能力。

The legislative capacity of the municipal People＇s Congress regarding the newly acquired legislative power cannot meet legis- lative needs, so we must strengthen the municipal People＇s Congress legislative capacity-building. The scientific selection of People＇s Congress deputies by strengthening the training of elected representatives, by extensive study and discussion, by turning the full-time and professional representations, and other measures to promote legislative capacity of People＇s Congress in the cities with subordi- nate districts. At the same time, we will ensure and protect the legislative capacity of the municipal People＇s Congress, which establish and improve the legislative system of the leadership of the Party, the dominant position and major role of People＇s Congress as well as the orderly social participation. Besides, the legislative capacity building of the People＇s Congress is measured by the quality of local legislation and the actual social impacts. Accordingly, we must optimize the operating mechanism of local legislation and improve the legislative ability continuously.
