地方立法公众参与的问题及对策——以惠州市为例

Problems and Solutions of Public Participation in Local Legislation——The Case of Huizhou

地方立法公众参与存在的问题有立法信息公开制度尚未建立、公众主动性积极性不高、地方立法公众参与途径有限、公众参与缺乏相应的制度保障等。导致出现这些问题的原因主要有观念、制度、利益和能力等方面的原因。切实提高公众参与地方立法实效的对策是培育公众参与责任意识、构建公众参与制度保障、破除公众参与利益壁垒和提升公众参与议法能力。

The problems existing in the public participation in local legislation can be summarized as follows： legislation information disclosure system has not yet been established, the public initiative enthusiasm is not high, the ways for local legislation in terms of public participation are limited, as a result, there is a lack of corresponding institutional guarantee for public participation, and so on. These problems are mainly caused by reasons concerning concept, system, interests and ability and others. The countermeasures to fa- cilitate the public participation in local legislation and to improve its effectiveness are for the purposes of cultivating the public aware- ness of responsibility in participation, of having institutional guarantee for public participation, of eliminating the interest barriers in public participation, and of building the capabilities in public participation.
