专利运营基本问题探析

我国专利运营在产生和发展的不同阶段具有不同的内涵,这些内涵体现了专利运营某些方面的属性,但并没有体现专利运营的本质,很难对专利运营进行准确定义。专利运营是专利与资本结合的产物,专利运营的本质是专利权的资本化。所谓专利运营是指优化专利权的市场配置,提升和实现专利权价值的商业方法和经营策略。专利运营具有主体多样性、对象特殊性、目的唯一性和支撑条件复杂性等特征。专利运营的概念与专利利用、专利运用、专利实施、专利转化和产业化等相关概念存在着较大区别,不能相互替代使用。

China＇s patent operation has different connotation in different development stage. The connotation reflects some attribution but not the nature of patent operation, therefore it is hard to accurately define patent operation. The paper asserts that patent operation is the combination of patent and capital, and the nature of patent operation is capitalization of patent right. The so-called patent operation refers to the business method and strategy to optimize the market allocation of patent and enhance or realize the value of patent. Patent operation has multiple characteristics, including diverse subjects, special objects, exclusive purpose, and complex support. The concept of patent operation is widely different from the concepts of patent use, patent application, patent implementation, patent Iransformation, patent industrialization and other related concepts, and they can＇ t subsitute for each other.
