农村基层治理法治化建设研究——以浙江省湖州市、丽水市为例

Research on Legal System Construction of Rural Basic-Level Governance:Case Studies of Huzhou City and Lishui City in Zhejiang Province

农村基层组织是社会组织的细胞,其法治化建设是全面推进依法治国的基础和工作重点。当前农村基层治理中存在着村民法治意识薄弱、村委会选举操作不规范、村级基层组织管理偏弱、号召力降低等问题。为了提升农村基层治理法治化程度,应培育村民的法治意识和思维习惯,推动乡村从人情社会走向规则社会;正确界定权力与职责范围,完善农村基层治理组织机构;规范基层组织选举制度,将"能人"纳入法治化管理轨道;探索建立惩戒制度,使农村基层组织成员进退有据。

Rural basic-level organizations are the cells of the society, the legal system construction of which is the foundation and focus of comprehensively enhancing the government of our country by law. Currently, there are some problems in the rural basic-level governance, such as weak awareness of the rule of law among the villagers, nonstandard village committee election, weak management of rural basic-level organizations, and reduced rallying point. In order to improve the rural basic-level governance under the rule of law, we should cultivate the villagers ’ awareness of the rule of law and thinking habit, so as to transform the country from a society of human relationship to that of rule-governed society. We should correctly define the powers and responsibilities to improve the rural basic-level governance organizations. We should standardize election of basic-level organizations, incorporating the “wise men” into the rule of law. We should establish the system of punishment so that members of the rural basic-level organizations could behave according to the legal ground.
