摘要
实施食品召回制度的前提就是"不安全食品"的存在,那么对"不安全食品"就存在一个认定问题。根据《食品安全法》的规定,"不安全食品"的基本含义包括两个方面:一是国家法律法规禁止生产的食品;二是生产经营的食品不符合食品安全标准。除食品生产经营企业主动认定并召回外,通常"不安全食品"的认定权属于政府食品药品监督管理部门,同时对食品不安全的认定要遵循正当程序原则。我国应建立完善"不安全食品"认定的相关制度,如建立在食品生产经营的企业关于"不安全食品"的认定前提下的食品药品监督管理部门的复核认定;建立完善的食品安全标准体系;建立食品追溯制度;完善第三方独立的检测与认定机构设置;完善我国"不安全食品"
The premise of implementing the food recalling system is the existence of "unsafe food". So there is an problem that how to identify "unsafe food". According to the regulation of "Food Safety Law",the basic meaning of "unsafe food"includes two aspects: one is the national laws and regulations banning the production of food; the second is the production and business operation of food does not meet the Food Safety Standards. In addition to food production and management enterprise recognize and recall actively,usually the right of identifying "unsafe food"belongs to the Department of Food and Drug Administration,as well as the produce of identifying food is not safe need to follow the principle due process. Our country should establish and perfect the related system about identifying "unsafe food ",such as Department of Food and Drug Administration review identifying food under the premise of the food's production and operation enterprises determined they are "unsafe food"; establish a perfect standard system of food safety; set up a food traceability system; perfect setting up the third party testing and accrediting independently; perfect the program of identifying "unsafe food"program and the release information unify system,etc.
