On Unit Crimes and Related Criminal Policies

在发展社会主义市场经济的进程中,单位犯罪大量存在,危害严重。单位犯罪不仅存在于经济领域和社会管理领域,也存在于其他领域;其所折射出来的社会问题是单位利益和社会利益严重冲突,所造成的社会危害性远比自然人单个犯罪要大得多。我国应全面设计《单位犯罪处罚法》,科学、有效地实行"双罚制",采取有针对性的刑事政策,实现对单位犯罪的有效整治和主动预防。

In the course of developing socialist market economy, unit crimes exist on a large- scale, doing large harms. The unit crimes exist not only in the fields of economy and society administration but also in the other fields as well. The problems that the unit crimes refract are the conflicts between the unit benefits and the social ones, and the harms that unit crimes do are much more serious than natural person individual crime does. We should design “The unit crimes punishment law” in an all-round way, put “the double punishment mechanism” into practice scientifically and effectively, and adopt correlative criminal policies, for the sake of realizing renovating units crimes effectively and preventing actively as well.
