《人民法院民事裁判文书制作规范》体现了中国直接适用宪法的最新态度。作为宪法适用重要方面的宪法解释制度涉及解释主体、方法、原则以及体系等内容。宪法解释方法的选择和运用是宪法学理论和实践发展的关键,宪法规范本身性质之多元性及结构之开放性决定了宪法解释方法的独特性。所以,宪法解释方法选择和运用必然不同于一般法律解释,应秉持中国本土化的思想,注意文义、历史、体系、目的以及社会解释等方法的综合运用,实现宪法解释结果的客观性和说服性。

The tendency of direct application of the Constitution has been reflected in the People＇s CourtCivil Adjudication Instrument Production Norms. The constitutional interpretation system, which is an important aspect of the application of constitution, involves the interpretation of subject, method, principle and system. The choice and application of constitutional interpretation is the key to the development of constitutional theory and practice. The plural nature of the constitution itself and the openness of the organization determine the distinctiveness of the method of constitutional interpretation. Therefore, the choice and application of the constitutional interpretation method must be different from the general legal interpretation. We should uphold the idea of localization in China, pay attention to the synthetic use of the meaning, history, system, purpose and social explanation, and realize the objectivity and persuasion of the result of constitutional interpretation.
