不动产统一登记视野下的农村不动产登记问题

On Registration of the Rural Real Estate after the Implementation of the Unified Registration of Real Estate

随着2015年3月《不动产登记暂行条例》和2016年1月《不动产登记暂行条例实施细则》的相继实施,全国开始推行不动产统一登记的确权工作。长期以来,我国关于城市不动产登记管理制度的完善受到较多的关注,相较于城市,农村不动产登记问题存在滞后性和诸多复杂性,相关研究也较为薄弱。农村地区不动产登记要实现与城市并轨的统一登记还存在阻力和障碍。在完善不动产登记相关立法的过程中,不应忽略农村实际,应对长期以来在农村地区发挥着稳定交易秩序作用的农村习惯法和乡村法秩序的特点给予充分关注。在现行制度和政策框架下,农村和城市还不宜实行全国统一的登记模式。

With the implementation of ＂The Provisional Regulations on Real Estate Registration＂in March 2015 and ＂The Detailed Rules for the Implementation of Real Estate Registration ＂in January 2016,the real estate registration began in our country. However,much attention is paid to improving the real estate registration system in cities,but less to that in rural areas out of its hysteresis and complexities,so it is hard for the rural areas to keep pace with the urban areas. It is suggested that in improving the real estate registration system the rural reality should not be ignored. More consideration should be given to the characteristics of the rural customary law and the rural law order for a long time. Under the existing system and policy rural and urban areas could not use a unified registration model.
