论生态文明体制改革背景下林业生态环境保护制度创新——以法律制度创新为视角

System Innovation in Forestry Ecological Environmental Protection in the Context of System Reform in Ecological Civilization——From the Perspective of Legal System Innovation

林业是生态文明建设的基础和关键,对林业生态环境的保护是建设林业生态文明的基本要求。党的十八届四中全会提出,要建设中国特色社会主义法治体系,建设社会主义法治国家,用严格的法律制度保护生态环境,促进生态文明建设。对照生态文明建设的要求,我国林业生态环境保护制度还存在一些不适应,需要进行不断创新和完善。文章分析了我国林业生态环境保护法律制度存在的问题,提出了在生态文明体制改革背景下创新和完善林业生态环境保护法律制度的建议。

Forestry is the foundation and key element in the development of ecological civilization, which indicates that the protection of forestry ecological environment is the basic requirement in developing forersty ecological civilization.The Fourth Plenary Session of the 18 th CPC National Congress advocates that we should form a system serving＂the socialist rule of law with Chinese characteristics＂and build a country under＂the socialist rule of law＂as well as promote ecological civilization by protecting the ecological environment with strick legal system. Evaluating against the requirements in ecological civilization development, there are some maladjustments in our forestry ecological environmental protection system, which shows that there is room for continuous innovation and improvement. This paper analyzes the problems lying in the legal system of forestry ecological environmental protection in our country and offers suggestions about the innovation and improvement of the legal system in the context of system reform in ecological civilization.
