论经济法制定与实施的外部性及其内在化

On Externality and Internalization of Formulation and Implementation of Economic Law

经济法作为规范经济市场秩序,加强市场宏观调控作用的主要依据,在其制定与实施过程中往往会带来一些非自愿的受益或成本,这就是所谓的外部性。外部性是经济活动的基本特性,如果不能对其进行有效控制则会给市场经济带来不好的影响。本文首先对经济法制定与实施过程中的外部性的基本内涵进行了介绍,然后分析了经济法外部性产生的根源,最后对外部性的内在化及具体的措施进行了简单的讲解。

Economic law, as the main basis for regulating the order of economic market and strengthening the macro-control function of the market, often brings some involuntary benefits or costs in the process of formulation and implementation, which is called externality. Externality is the basic characteristics of economic activities, if not effective control, it will bring a bad influence on market economy. This paper first introduces the basic connotation of externalities in the process of formulation and implementation of economic law, then analyzes the origin of the externality of economic law, and finally, the internalization of externality and the concrete measures are briefly explained.
