论日据时期台湾农田水利法制的殖民化

On the Colonization of the Legal System of Farmland Water Conservancy in Taiwan during the Period of Japanese Occupation

日据时期,为满足殖民统治和经济掠夺的需要,日本殖民政府在调查台湾水利旧惯和移植日本国内水利法制的基础上,先后通过建立公共埤圳、官设埤圳、水利组合制度,逐步实现了埤圳的公共化和农田水利管理的法制殖民化,尽管在短时期内使台湾农田水利法制实现了近代化,客观具有一定的进步性,但这一进步是奠基于对台湾人民的殖民掠夺之上的,处处优先考虑日本殖民者的利益,呈现明显的"殖民性"因素。

In order to meet the needs of colonial rule and economic plunder, the Japanese colonial government established successively the public and official irrigation ditches system and water conservancy combination system on the basis of the in- vestigation of the traditional practice of Taiwan water conservancy and the legal system of the transplantation of Japanese water conservancy during the Japanese occupation period and gradually achieved its public irrigation ditches as well as legal coloniza- tion of water conservancy management. Despite the fact the farmland water conservancy legal system in Taiwan had realized its modernization in a short period of time and objectively achieved some progress, the progress was based on the colonial plunder of the people of Taiwan with the priority given to the Japanese colonial interests and the obvious ＂colonial＂ factors as well.
