求偿权是消费者的一项基本权利,惩罚性赔偿请求权也是消费者的权利,是求偿权的延伸。文章以消费者权利为视角,阐释了食品消费者惩罚性赔偿请求权的理论基础,探讨了其价值目标和功能,分析了食品消费者惩罚性赔偿请求权的行使要件,建构了食品消费者惩罚性赔偿请求权的程序机制。

The fight to redress is one of basic consumer fights. The claim in punitive damages is the extension of the consumers＇ fight to redress. From the perspective of consumers＇ fights, this article mainly focuses on the fight to redress by means of punitive damages. The basic theories of the fight are introduced, the value and function of the fight discussed, the elements for exercising the fight analyzed, and the procedures for the exercise of the fight improved.
