非法行医属于卫生计生行政部门执法案件中的重点,由于其形式多样,且隐蔽性、流动性较强,证据收集困难,成为一个难点问题。而涉及非法行医案中非法所得确定的环节,则更是难点中的难点,也是多年来不少办案人员不愿触碰的领域。本文以一起典型的非法行医案进行剖析,从合法、合理、程序正义的角度,探讨针对这一类违法行为非法所得的证据收集、排查和最终认定的具体方法,并就相关问题提出建议。

Illegal medical practice is the focus of the health administrative management.Due to its various forms,and concealment,liquidity,it is hard to collect evidences.Work about the illegal income of illegal medical practice is more difficulty,which is the area that no one is willing to touch.In this paper,the author discussed the typical cases of illegal medical practice from the perspective of legal,reasonable and procedural justice.Study on the specific methods about this kind of illegal behavior illegally obtained evidence collection,screening,and ascertaining,and puts forward suggestions on related problems.
