摘要
阐述了城市地下空间的概念及城市地下空间建设用地使用权出让金的法律基础,分析了城市地下空间建设用地使用权出让金的影响因素及评估方法。以上海、福州、温州、无锡等城市为例,列举了在具体的实践中地方性政策法规有关城市地下空间建设用地使用权出让金确定的规定,其中分层出让是一个特色;参考了其他学者提出的出让金估价公式,指出地下空间建设用地使用权出让金与参考地价、地下空间建筑所增加的建造成本及地下空间开发利用效能递减比例相关,为土地出让金的确定提供理论基础。
The concept of urban underground space and legal basis of transaction fees of urban underground space construction land use right were elaborated. Influencing factors and evaluation methods of transaction fees of urban underground space construction land use right were ana- lyzed. Taking Shanghai, Fuzhou, Wenzhou, Wuxi for example,the local policies and regulations in the specific practice about transaction fees of urban underground space construction land use right were listed, the feature of which was layered to transact. Referring to the formulation of the transaction fees which other scholars think up ,point out that the transaction fees of urban underground space construction land use right was inter- related to the price for reference of land, the cost of increased underground space construction and diminishing efficiency ratio of underground space development and utilization,which would provide the theoretical basis for the future land transaction.
