中国社会组织黑名单制度研究:价值分析、现实困境与建构路径

The Blacklist System of Social Organizations in China:Value Analysis,Realistic Predicaments,and Realization Paths

[目的/意义]黑名单制度是政会脱钩后我国政府部门加强社会组织事中事后监管的新型工具。目前我国学界尚无专门针对社会组织黑名单制度的研究,试图弥补该研究的不足。同时给今后我国社会组织黑名单制度的建设和完善提供借鉴与启示。[方法/过程]基于我国社会组织黑名单制度的价值分析,检视了当前我国社会组织黑名单制度实施过程中面临的四大困境,包括实施非规范化困境、制度异化困境、管制范围受限困境以及管理碎片化困境。[结果/结论]我国未来社会组织黑名单制度的建构可以通过法治环境的完善、统一信用信息平台的建设、政府部门的组织建设、失信惩戒共治体系的构建和制度本身奖惩机制这五个路径得以实现。

[ Purpose/Significance] Blacklist system, is the new tool for the government to strengthen social organizations＇ regulation in process and afterwards. The researches specifically exploring the blacklist systems of social organization academically are few so far in China. This study seeks to fill the gaps in this field. Besides, the study can also offer references and enlightenment to the building and perfecting of blacklist system of social organizations in China henceforth. [ Method/Process] Based on the value analysis of the blacklist systems of social organization in China, the study inspects the four kinds of realistic predicaments that the blacklist systems of social organization piloted are confronted with, namely the implementation non-normalization, system heterization, regulation range limitation, and management fragmentation. [ Result/Conclusion ] The paper suggests that the construction of the blacklist systems of social organization in China should focus on the following five approaches： the perfection of the legal environment, the construction of the unified credit information platform, the organizational building of the government, the construction of common governance system for the penalty of faith -breaking, and the optimization of the system of reward and punishment.
