政府、社会和高校的三元治理模式,强调高等教育管理权在政府、社会团体和高校之间的分散和制衡。三元治理模式的关键是制度创新,包括宏观上政府简政放权的制度创新、中观社会团体的制度创新和微观高校自主权的制度创新。宏观政府的制度创新,主要是指政府的简政放权,把一些权力和职能让渡给社会团体和高校,并建立和完善相关的机构和制度。中央和省级政府建立高等教育发展规划委员会、高等教育质量监督与管理委员会及高等教育拨款委员会。中观社会团体的制度创新,不仅要关注到政府权责内的全国性重大问题,还要关注高校实践领域的各种具体问题。出台社会团体法人资格法规;增设有关社会团体管理权限的法律规定;制定社会团体运行模式的政策。微观高校自主权的制度创新,需要从确立高校的法人实体地位着手,理顺高校内部治理机构中的党政和教师、学生及相关利益主体的关系,并以党政关系为主轴进行制度创新:制定高校法人实体的相关法律制度;加快高校内董事会制的改革,实行高校内领导体制董事会制。

A ternary governance mode of government,social organization and university emphasizes the higher education management among the government,social organization and university.The key to ternary governance mode is institutional innovation,including the system innovation of decentralization of macro government,the system innovation of social medium organization and the micro system innovation of university autonomy.The macro system innovation of the government is mainly about streamlining administration and powers of the government,assigning some powers and functions to social organizations and colleges,and establishing and perfecting the relevant agencies and system,which includes:The central and provincial governments establish the council for higher education development planning;the central and provincial governments set up higher education quality supervision and management committee;the central and provincial governments establish higher education funding council.The medium system innovation of social organizations should focus not only on the governmental responsibilities within the na-tional major issues,but also on specific problems in the practical field in colleges and universities.The content includes:Introducing the corporative qualifications of social groups regulations;establishing related social organizations administrative authority of law;formulating social groups operating mode of policy.The microscopic system innovation of university autonomy,which needs to start with the establishment of the legal entity status of colleges and universities,disentangles the internal governance mechanism in colleges and universities among the relationship of party,government and teachers,students and interest-related parties,and carries on system innovation with the primary shaft of the party and the government,which includes:Setting up the legal entity related legal system;formulating corporate entity of colleges and universities related legal system;speeding up the reform of the system of the board of directors within colleges and universities,and implementing the system of the board of directors within colleges and universities.
