摘要
2016年1月1日公布并实施的《不动产登记暂行条例实施细则》废止了继承登记强制公证,并进一步将不动产登记机构的职责细化为形式审查。但继承登记自身的复杂性又需要实质性审查,这就会引发继承登记公信力问题。深层次的继承登记法律问题是继承登记利害关系人权利义务的合理配置欠缺和继承登记公证收费标准一刀切问题。兼顾减轻继承登记申请人负担与保证继承登记公信力,需要将继承登记公示催告作为继承登记的前置程序。继承登记公示催告程序包括申请人、处理机构、申请审查、发布、异议处理和效力等方面的内容,应当拟定为具体法律条文纳入《继承法》之中。
Released and implemented in January 1,2016,Detailed Rules for the Implementation of the Interim Regulation on Real Estate Registration abolished the compulsory notarization for the registration of succession,and further refined the real estate registration duties in the form of review mechanism. But the inheritance registration does need the substantive examination because of its complexity,and this leads to inheritance registration credibility problems. The deep inheritance registration legal problems include the lack of reasonable allocation of rights and obligations of the inheritance registration stakeholders and the lack of necessary flexibility of the notary fees standard on inheritance registration. To balance reducing the applicant burden of registration of inheritance and ensuring the inheritance registration credibility,the public peremptory notice of registration shall be the pre-registration program of inheritance registration. The public peremptory notice systems of inheritance registration including five aspects refer to the applicant,disposal agency,application review,publish,objection handling and effectiveness,and the specific legal provisions should be drafted into the Law of Succession.
