摘要
行政审批中介管理制度是推动行政审批中介改革的重要内容之一。设计得当,政府监管到位的管理制度有利于行政审批中介成为有效的政府规制工具。本研究通过对比建设工程领域内地与香港行政审批中介管理制度,分析两地管理制度在资质设立基础、资质主体、管理主体、管理依据等方面的差异,指出内地行政审批中介管理制度以政府为主导,同时针对内地问题及香港经验提出对策建议。
Regulations on third-party agencies involved administrative approval are crucial to China＇ s administrative approval reform. Well-designed regulations with strong government oversight can facilitate the third-party agencies to cost-effective function as an instrument of government social regulation. This article argues that the regulatory regime on third-party agencies in China's Mainland is centralized and government-dominated based on the comparison between China's Mainland and Hong Kong in social construction projects, by which policy suggestions are provided.
