随着中国军事实力的增强,中国军队参与海外维和行动已逐渐常态化。为中国军队海外维和行动提供法律保障,不仅能确保维和行动的合法化和规范化,也可以维护中国军队作为海外维和行动主体的合法权益。当前,我国法律保障的范围和力度已难以适应中国军队海外维和行动的现实需求。因此,我们应当在完善海外军事行动立法的同时,强化法律运行机制和人员保障,以满足我军海外维和行动常态化发展的实践需求。

Chinese military takes participate in overseas peacekeeping operations that are gradually normalized when the military power is increasing. Legal safeguards for the Chinese military will not only ensure the legalization and standardization of overseas peacekeeping operations, but also safeguard the legitimate rights and interests of the military as the major actor. At present, the scope and strength of Chinese legal protection has been difficult tn adapt to the requirements of the Chinese military involved in overseas peacekeeping operations. Therefore, we should improve the legislation of overseas military, operations, strengthen the legal operation mechanism and personnel protection to meet our military needs for the normalization of overseas peacekeeping operations.
