我国警察举枪行为的法律规制研究

Legal Regulation on Police Behavior of Raising Gun in China

举枪是警察使用枪支的一种独立的行为形态,具有多重性质和作用,需要立法和警察政策加以专门规制,以充分发挥其在执法中的效能,减少其风险和危害。规制的重点内容是警察举枪行为的适用条件和程序。我国可以针对不同类型的举枪行为设定不同的适用条件,设置相对简便的事后报告和调查程序,使警察在执法实践中敢于和善于依法举枪,实现执法目的。

As an independent behavioral form of police using gun,raising gun,which has multiple characteristic and functions,needs to be specially regulated by legislations and police policies in order to give full play to its effectiveness and minimize its risks or hazards in law enforcement. Emphases of regulation are applicable conditions and procedures of raising gun. Legislations and police policies in our country should regulate applicable conditions for different types of raising gun behavior,and set relatively simple procedures for post- incident report and investigation. The aim to do so is to make the police be bold and skilled in raising gun in law enforcement practice in accordance with regulations,and achieve law enforcement purposes.
