法治具有目的性

The Purposefulness of the Rule of Law

法治是依照法律进行治理的社会状态,也是人类所追求的良好秩序和生活方式。在我国,法治内在包含着"规范公权,保障私权"的价值,以及人类追求公平正义的诉求。建设社会主义法治国家,是宪法确立的目标,也是全面建设小康社会的应有内涵。市场经济本质上是法治经济。如果把法治简单地视为一种保障经济发展的工具,则法治建设可能会趋向于追逐短期目标,甚至流于形式,社会发展也就迷失了前进方向。

The rule of law represents a desirable social order and way of life that humanity pursues. In China, the rule of law has intrinsic value of 'regulating public rights and guaranteeing private rights' as well as pursuits of fairness and justice. To build a socialist country of the rule of law is the goal of the Constitution, and a necessary requirement of the drive to build a moderately well-off society. The market economy is essentially an economy of the rule of law. If the rule of law is approximated into an instrument providing for economic development, then China's effort to promote the rule of law may end up short-sighted, ritualistic, and ineffective in guiding social development.
