On the Legal Faith and Systematic Rhetoric

法律信仰不仅是法律作为逻辑、理性和科学的产物,也是法律作为修辞、诗性和诠释的产物。因此,法律信仰是法律作为制度修辞的必要要素。它既作为精神修辞作用于法律制度,也作为制度修辞作用于法律制度。法律信仰与制度修辞的基本联结方式,是依赖可形式化的语言和言语来实现的。法律信仰和制度修辞都具有浓厚的诗性思维特征。无论权利的授予,还是义务的约定,都可证诗性思维、法律信仰和制度修辞三者之间的联结。

Legal belief is not only the product of law as logic, reason and science, but also the product of law as rhetoric, poetry and interpretation. Therefore, the legal faith is a necessary element of systematic rhetoric. It is as the rhetoric of spirit to the legal system, also as a function of systematic rhetoric in legal system. The basic connection between legal belief and systematic rhetoric depends on the formal language. The legal faith and systematic rhetoric have the characteristic of strong poetic thinking. Whether the grant of rights, or obligations agreed, can prove the links between poetic thinking, legal beliefs and systematic rhetoric.
