司法大数据的开放与共享

Research on the Opening and Sharing of Judicial Big Data

随着互联网技术的深入发展,数据的开放与共享成为经济和社会发展的重要动力。作为社会公共数据的一部分,司法大数据的开放与共享具有提高司法质效、促进司法公正、深化司法改革、推动法律实施、参与社会治理等五大功能。目前,由于在司法统计人财物投入方面有限、法律法规的滞后以及部门之间数据堡垒的存在,我国司法数据的公开程度还不高,司法大数据应有的功能未能得到充分发挥。为改变此局面,需要从战略高度重视司法大数据的开放与共享,通过首先打破部门壁垒的方式,逐步实现数据的全面开放。同时,应完善数据开放与共享程序,统一司法统计的元数据标准,构建综合司法信息公开平台,以实现促进司法公正、深化司法改革的目的。

With the development of Internet technology, the opening and sharing of data has become an important driving force of economic and social development. As a part of social public data, the opening and sharing of judicial data has five functions ： improving judicial quality, promoting judicial justice, deepening judicial reform, promoting the implementation of law, and participating in social governance. At present, however, the openness of our judicial data is not high and the function of judicial data has＇ not been fully exerted, due to the limited investment in judicial statistics, the lag of laws and regulations, and the existence of data bastion between the departments. In order to change this situation, we need to attach great importance to the opening and sharing of judicial data from a strategic perspective, and gradually open up the data by breaking down sectoral barriers. At the same time, we should improve the data opening and sharing procedures, unify the meta - data standard of judicial statistics, build a comprehensive platform of judicial information to achieve the purpose of promoting judicial justice and deepening the judicial reform.
