摘要
医务人员履行告知义务是患者实现知情同意权的前提。在实践中,由于伦理精神的缺失,告知义务反而阻碍了患者权利的实现,导致医患关系愈发紧张。为了达到医疗告知法律制度的目的,应当以医学伦理精神为指引,完善现行法律规范,制定患者权利单行法,推动医患关系良性发展。
Patient＇s right of inform consent rely on inform obligation, in practice, because of deficiency of ethical spirit, it be- comes obstacle of patient＇s right, making doctor-patient relationship strained. In order to realize the aim of medical inform law sys- tem, we should follow medical ethical spirit, improve legal rules, enact patient＇s right law, promote establishment of better relation between medical professions and patients.
