被遗忘权的场域思考及与隐私权、个人信息权的关系

The Field Thinking of Right to be Forgotten and the Relationship with Privacy Right and Right of Individual Information

被遗忘权不仅在大数据领域中存在,而且在古典的隐私权或者个人信息权(信息隐私权)领域中也存在。在大数据领域中,被遗忘权以删除权为主要内容,而在非大数据领域中,被遗忘权以禁止或者限制收集、使用为主要内容。在大数据领域中,被遗忘权的出现并没有产生一种完全独立的新兴权利,毋宁是在古典隐私权的地基上并依赖于个人信息权(信息隐私权)的保护,增加了广义的隐私权的内容。对个人信息权和被遗忘权的认知应当在古典隐私权的地基上进行。

The right to be forgotten not only exists in the field of big data, but also exists in the field of classical privacy fight and the right of individual information. In the field of big data, the right to be forgotten mainly contains the right to be deleted. However, in other fields, it mainly contains prohibitions and restrictions on collecting or using. The occur- rence of the right to be forgotten in the field of big data isn＇ t accompanied by any new right. Rather than on the basis of classical privacy right, it is dependent on the protection of the right of individual information, adding the contents of gen- eralized privacy right. Cognizing the right to be forgotten and the right of individual information is ought to be based on classical privacy right.
