农村土地交易制度研究述评

Review of the Studies on Rural Land Transaction System

土地是中国广大农民赖以生存的基本保障,亦是农村最有价值的资源。在农村土地的交易问题上,目前的研究已经提出将市场化改革作为农地交易改革的突破口,并就此目标推出部分地区试点研究。通过梳理有关"农村土地交易制度"的学术文献,从农村土地产权、农村土地交易的界定、农村土地交易的模式和纠纷进行综述,归纳未来研究的重点:农村土地交易制度改革的顺序问题;农村土地交易矛盾持续不断;永久基本农田划定与国家"公益"征地矛盾问题;产权权利束的划分与突破。

Rural land is not only the fundamental element on which presents rely for existence, but also the most valuable source in rural areas. As for the issue of rural land transaction, some present studies have put forward the suggestion of taking market-oriented reform as the breakthrough of rural land transaction reform, and have brought forward some areas to conduct pilot researches in. This paper tried to induce the focuses of future study of the topic by reviewing academic papers concerning ＂rural land transaction system＂ and from the angles of property right of rural land, definition and patterns of rural land transaction, as well as disputes over the transaction. The focuses might be involved with the sequence of rural land transaction reform, incessancy of transaction disputes, contradiction between permanent basic farmland and national land acquisition for ＂public welfare＂, and division and breakthrough of property rights bundle.
