The recognition of an illegal new drug and its range will directly affect the convicting and sentencing in drug-related crimes. However the incompleteness in determining a new drug＇s type and range in the laws available has led to the ambiguity and difficulty in judicial practice. Based on the comprehensive analysis of some problems in determining a new drug＇s type and range,and lessons learned from the legislation of an illegal drug of other countries and regions,some measures and suggestions are proposed in the paper.
