摘要
听证会作为一种旨在促进公众参与的制度形式,自20世纪末引入我国以来,逐渐在行政处罚、公共价格决策、环境政策以及城市规划等行政过程中得以应用。随着实践的深入,听证会中公众参与的价值及效果问题日益成为学界研究的热点。本文从理论与实践、解释与对策等方面将国内学者针对听证会中公众参与问题的研究进行了梳理,以期厘清听证会中公众参与问题的研究脉络,为学界进一步研究提供参考。
The Hearing has been adopted in Chinese administration system since the end of 20th century and it has been applied in almost all kinds of administrative processes,especially in administrative penalty,public price policy,environmental policy and city planning.At the same time,the research on public participation value and effectiveness during the Hearing becomes very hot.This essay bases on domestic researches of public participation during the Hearing, generally analyses relevant theories,practices,problems and solutions.The aim of this easy is to clarify the context of public participation in the Hearing and prepare for future researches.
