论主审法官责任制

On the Responsibility System of Presiding Judge

为了巩固法官的独立地位和提高案件审判质量,主审法官责任制在最新的司法改革中被高度重视。主审法官责任制对于实现"让审理者裁判,由裁判者负责"具有十分重要的意义,但是,当前的制度设计中只有大体的轮廓,并没有统一具体的规范,导致主审法官责任制的推行在新一轮的司法改革中还存在着重重困难。因此,我们仍需理性审视主审法官责任制在实践中面临的问题并提出合理的应对之策,使得主审法官责任制进一步完善,实现法官依法独立办案,重新塑造法院形象,加强司法权威和公信力。

In order to consolidate the judge＇s independence and improve the quality of trial, the presiding judge responsibility system in the latest judicial reform was to be highly valued. The presiding judge responsibility system for implementing ＂having the trial judge, having the judge responsible for the results＂ is of great significance, however, only a general outline of the current system is designed, and no unified standard is set forth, which causes difficulties in the new round of judicial reform of presiding judge responsibility system. Therefore, we still need rationally examine the problem so that the presiding judge responsibility system in practice are facing with and put forward reasonable responses to make the presiding judge responsibility system be further improved and the judge can implement work independently in accordance with the law, reshaping the image of court as well as strengthening judicial authority and credibility.
