在中国刑事司法裁判活动中,通常将"定罪"和"量刑"放在一起做出裁断,力图通过一个程序解决两个问题,这符合司法效率原则。文章聚焦于定罪的社会后果分析,从经济学、社会学和法学等视角,剖析定罪对国家司法机关、被告人以及整个社会产生的影响,认为法官在进行认定犯罪的过程中,应当考虑时代的需求,社会发展的趋势,普通人的常识、常理及常情等方面因素。

In Chinese criminal justice activities, ＂conviction＂ and ＂sentence＂ are usually on the findings made together, trying to solve two problems through a program, which is in line with the principle of efficiency. Articles focus on the social conse- quences of a conviction analysis, in terms of economics, sociology and law, analysis conviction of national jurisdictions, the impact of the defendant and the entire society. During the course of the judge finds that crime , we should take age de- mand, the trend of social development, and common sense of ordinary people and other factors into consideration.
