兴奋剂“违禁”救济及NSF规则——莎拉波娃上诉案之启示

Doping Remedy Procedure and NSF Rules Seen from Maria Sharapova's Appeal

通过CAS莎拉波娃上诉案,从运动员权利保护的角度阐述了兴奋剂处罚的NSF规则、CAS仲裁庭的立场、以及WADA和体育组织在制定规则时需要完善之处,并加以分析案件带来的启示,尤其对我国运动员及相关机构和人员在反兴奋剂活动中面对被"违禁"的处理有一定启示。同以往"谈虎色变"的态度不同,研究认为我们应该理性地看待兴奋剂违禁事件,应着眼运动员的主观态度,故意违禁以达不法目的应严惩,但若构成NSF,也应该鼓励运动员维护自己应有的权利。

This paper expatiated on the rule of NSF and the position of the CAS from the perspective of the right of athletes.It further analyzed the attitude of WADA and sports organizations when the rules needed revision,and the case revelation of Maria Sharapova‘S appeal to CAS.Instead of being worried about doping,it was better to focus on the intention of the athletes.Deliberate doping should be severely punished.If it were NSF,the athletes should appeal to maintain their rights.
