论民族自决权的概念内涵与适用条件

On the Connotation and Application Conditions of the Right of National Self-determination

民族自决作为现代国际法的基本原则,曾在全球反殖民斗争中发挥了特殊作用。在不同历史条件下,民族自决权的内涵也相应地发生变化。分析在当今全球化语境下民族自决权的丰富内涵,阐释民族自决权与人权、主权之间的联系与差别,在对民族自决权进行正确解读的基础上批判民族分离主义行径,对于维护多民族国家安全与稳定具有积极意义。

As one of the basic national principles, self-determination has played a special role in opposing global colonialism. The definitions of national self-determination will be different in different conditions. Analyzing the legal users and conditions of national self-determination in globalization and finding the difference among national self-determination, State Sovereignty and Human Rights are useful for us to animadvert National Separatism in Taiwan based on the correctly understanding of national self-determination.
