On Function of Ethnic Commercial Custom

民族商事习惯以"习惯"为物理载体,以"商事"为核心特征,以"民族"为交易特色,既来源于民事习惯,又形成民族特征,还属于民族交易经验规则总结;既没有改变商事通用性,又没有改变"习惯"本色,但还有"民族"特色;既有商事习惯的本位特性,又有民族习惯基因,还能发挥诸多功能:习惯交易提供常规功能,商事交易发挥专业功能,民族习惯交易显现特色功能,诚信交易提供道德善良基础发挥道德功能,商事价值成为民族商事习惯的核心功能。

Ethnic commercial custom is used to take custom as a physical carrier , commercial as a core feature, and ethnic as a transaction characteristic. It originates from civil custom as well as ethnic characteristics, and belongs to collections of ethnic trading experience. Neither the universal commercial traits nor “ custom” nature is changed. It keeps both commercial custom and ethnic custom genes. Moreover, it has many functions： custom transaction provides regular function; commercial transactions plays professional function; ethnic custom transaction shows feature function; honest transaction provides basis of moral goodness so as to play moral function. Thus, commercial value becomes the core function ofethnic commercial custom.
