澳门海域生态管治的必要性探析

On the Perfection of the Management System of the Sea Area of Macao

海域对澳门特别行政区具有极其重要的经济价值和生态价值.澳门特别行政区现行对习惯水域使用进行的管理是-种事实或习惯管辖,其管理制度不成体系,缺乏对海域经济价值发挥的有效保障和对海域生态价值激活应有的关切.在获得法定海域管辖权的新时期,澳门海域使用管理制度应该摈弃只强调海域经济价值和只注重公法管制的思维定势,采用既平衡海域经济价值和生态价值,又融合公法管制手段和私法治理手段的生态化管治范式.

The sea area adjacent to Macao has a very important economic and ecological value to Macao.Due to customary jurisdiction,the administrative system of the customary waters in the Macao Special Administrative Region lacks effective protection of the economic value and the concern of the activation of the ecological value of the sea area.In the new period of the legal jurisdiction,Macao Special Administrative Region should breakthrough the thinking set and the normal form of inertia and adopts the new way：Ecological Governance.This new way can keep the economic value and ecological value of the sea area in balance through the integration of public law and private law.
