Information Property Under the Perspective of Civil Rights Object

信息财产在实践中已大量存在,且其中有一部分已被纳入现有的部门法中进行保护。因其为新型的独立的财产形态,应成为继知识财产之后新出现的财产权的另一个客体、一种新型且独立的民事权利客体。但是目前实践中解决信息财产相关纠纷时的主要法律依据仍是民事法律体系中的部门法如合同法、侵权法、知识产权法等,显然这种不完整、不充分的保护形式存在着诸多问题。

Information property have been extensively exist in reality, and some of them have been incorporated into existing protection in the field of law. For the new type of in- dependent property form, should become the new property rights after intellectual property of another object, a new type of object and independent civil rights. But when information property related disputes in practice at present is still the main legal basis of civil law system of the department such as contract law, tort law, intellectual property law, obviously this is incomplete, inadequate protection form exists many problems.
